Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Counterspeech is a kind of communicative resistance that tries to oppose, neutralize or remedy harmful speech. It can be defined as a form of non-coercive intervention that is, in some cases, available for any competent speaker. In recent years, some philosophers of language have focused on analyzing and proposing different varieties of in situ counterspeech in the hopes that their insights about communicative mechanisms can contribute to the identification of efficient strategies. This investigation is however still new and in programmatic (...) expansion. Our first goal then is to suggest a separation between two categories of counterspeech, confrontational and redirecting, adopting the impact of the intervention on the cooperation between participants as an organizational criterion. Secondly, we propose a type of confrontational counterspeech, which we call elucidation, and a type of redirecting counterspeech, namely, reframing. In cases of elucidation, the recalcitrant hearer makes a problematic aspect of what was said salient. This is a way of calling the bigot out for the commitments that he/she undertakes in virtue of choosing to use certain words. In reframing, the recalcitrant hearer tries to neutralize the effects of code words by replacing them for semantically equivalent alternatives that have different social meanings and connotations. For example, replacing ‘ideologia de gênero’ (‘gender ideology’) by ‘diversidade de gênero’ (‘gender diversity’), when accommodated, gives the hearer additional control over the discursive topics (the QUD) and the “terms of the conversation”. Sendo assim, tão logo a escola passou a ser popularizada, a literatura teve, também, ampla divulgação nesse espaço. No entanto, apesar dessa relação ter sido iniciada por volta de cinquenta anos, cada vez mais, constata-se a dificuldade da escola na formação de leitores literários. ABSTRACT Science fiction is a literary genre that has spread around the world due, among other reasons, to its popularity; narratives contain exotic characters and fantastic intrigue. It is considered by the circle of scholars and critics, however, a “minor” literature; for discourse linguists, its aesthetic attributes remain in the background. The theory of points of view (POV), for example, can contribute to a better assessment of the genre. This article aims to study this literary genre via enunciation. First, we (...) talk about studies in narratology to delimit the place of science fiction (or sf) in the universe of narratives. Secondly, we talk about concepts and notations from POV theory within narratological studies to trigger a dialogical analysis of literary discourse. Thirdly, we analyze a fragment from Dune, by Frank Herbert, in its version into Brazilian Portuguese (2017). Benzodiazepines and antidepressants have been shown to change responses to unfairness; however, the effects of their combined use on unfairness evaluation are unknown. This study examines the effects of concomitant benzodiazepines and antidepressants long-term use on the evaluation of fair and unfair offers. To analyze behavioral changes on responses to unfairness, we compared the performance of medicated participants and healthy controls in the Ultimatum Game, both in the proposer and in the respondent role. The results showed that long-term psychotropic users (...) had the worse economic strategy by accepting less offers than control subjects. However, in the proposer role, the unfair offers made by participants were similar between groups. The present results suggest that long-term use of psychotropic medication, specifically the combination of benzodiazepines and antidepressants, may increase the sensitivity to unfairness, resulting in higher rejection rates in conditions where this strategy is the most disadvantageous. Este artigo buscou analisar alguns aspectos discursivos na obra Tenda dos Milagres, de autoria de Jorge Amado. Parte da percepção de que a discursividade religiosa que permeia a discursividade literária de Jorge Amado apresenta uma simbolização e ressignificação dos processos identitários, culturais e sócio-históricos próprios da matriz africana. Logo, adotando alguns dos procedimentos da análise do discurso sob uma perspectiva foucaultiana, o objetivo foi, por meio das práticas de subjetivação e objetivação, perceber as subjetividades que envolvem as vozes que emergem (...) no discurso religioso, o candomblé, na obra Tenda dos Milagres. As análises oportunizaram a constatação de que os silenciamentos e as subjetividades produzidas nos locais de moradia e no Candomblé constituem sentidos nos movimentos na e da história, na composição dos sujeitos do discurso e suas identidades, demarcando resistências e lutas que preservam a cultura, etnicidade, manifestações de fé e de pertencimentos dos sujeitos-personagens da obra desse escritor baiano. The coronavirus disease 2019 outbreak forced most of the world’s population to be confined at home to prevent contagion. Research reveals that one of the consequences of this confinement for children is an increased amount of time spent using screens (television, computers, and mobile devices, etc.) at home. This exploratory study aims to analyze the association between screen time exposure and emotional/behavioral problems of infants and children aged under 7 years, as manifested during the lockdown period in Portugal due to (...) the coronavirus disease 2019 outbreak. The study was controlled for sociodemographic and confinement variables. A sample of 193 parents of children aged from 6 months to 6 years and 12 months, residing in Portugal, completed a survey about the time and manner of use of screen time exposure of their children. Data were derived on circumstances both before and after the confinement; the survey also explored the child’s behavioral and emotional adjustment. The findings revealed a modest relationship between children’s exposure time to screens and behavioral and emotional problems on children studied. It was also found that parents may play an important role in children’s behavioral and emotional adjustment during the confinement period. (shrink)

Iowa Gambling Task (IGT) is one of the most widely used tools to assess economic decision-making. However, the research tradition on aging and the Iowa Gambling Task (IGT) has been mainly focused on the overall performance of older adults in relation to younger or clinical groups, remaining unclear whether older adults are capable of learning along the task. We conducted a meta-analysis to examine older adults’ decision-making on the IGT, to test the effects of aging on reversal learning (45 studies) (...) and to provide normative data on total and block net scores (55 studies). From the accumulated empirical evidence, we found an average total net score of 7.55 (± 25.9). We also observed a significant reversal learning effect along the blocks of the IGT, indicating that older adults inhibit the prepotent response towards immediately attractive options associated with high losses, in favor of initially less attractive options associated with long-run profit. During block 1, decisions of older adults led to a negative gambling net score, reflecting the expected initial pattern of risk-taking. However, the shift towards more safe options occurred between block 2 (small-to-medium effect size) and blocks 3, 4, 5 (medium-to-large effect size). These main findings highlight that older adults are able to move from the initial uncertainty, when the possible outcomes are unknown, to decisions based on risk, when the outcomes are learned and may be used to guide future adaptive decision-making. RESUMO Neste artigo, estabelece-se uma relação entre o conceito de autoria trabalhado por Bakhtin e Possenti e o de responsabilidade enunciativa, proposto por Adam. Para aqueles, a inserção de vozes alheias e o distanciamento em relação à linguagem são aspectos característicos de um texto autoral; para este, a responsabilidade enunciativa é uma dimensão constitutiva do enunciado e se relaciona ao agenciamento de vozes e ao uso de marcadores de pontos de vista. Partindo dessa discussão, analisam-se diários de leitura de estudantes (...) de Ensino Médio, observando como eles agenciam outras vozes e utilizam recursos de modalidades para constituir um discurso autoral. Os resultados apontam para a inserção de vozes alheias e utilização de lexemas afetivos, avaliativos e axiológicos nos diários, ora de forma mais elaborada e consciente, ora de forma mais simplória e carente de criticidade, do que se depreende a necessidade de atividades de retextualização para configuração de uma escrita autoral.ABSTRACT In this article, we established a relationship between the concept of authorship studied by Bakthin and Possenti and that of enunciative responsibility, as proposed by Adam. For the first, the insertion of the voice of others and the outsideness in relation to language are characteristic features of an authorial text; for the latter, enunciative responsibility is a constitutive dimension of the utterance and is related to managing voices and utilizing markers of points of view. From that discussion, we analyzed reading journals of high school students, observing how they manage the voices of others and use modality resources to attain authorial speech. The results point to the insertion of the voices of others and the use of affective, evaluative and axiological lexemes in the journals in more elaborate and conscious ways, and in simpler, less critical ones, from which one can surmise the necessity of retextualization activities in order to achieve authorial writing. Objective: To explore the strategies that can help individuals mourning a family member’s death from Covid-19 to cope with the loss. Method: We carried out a narrative review on the PubCovid-19 platform using the descriptors “death,” “mourning,” “Covid-19,” and “coping strategies.” Ten articles were included. Results: The strategies found are phone calls, audio recording, letters, and photos, classified as immediate and long-term. These strategies are focused on mental health, which can be adversely affected by depression and psychological disorders. Conclusions: Creating (...) counseling programs for the relatives of those who died from Covid-19 is urgent. They must offer comprehensive, humanized, and continuous mental health care. (shrink)

This article seeks to carry out a bibliographic review of the text “Proust and the understanding of pain”, by Franklin Leopoldo e Silva, originally published in Revista Discurso, 03 (1972). In the text in question, the main themes of the Proustian novel appear, such as time, voluntary and involuntary memory and oblivion, in the light of a core theme from the narrative point of view: pain. It seeks to answer the question: “Is finding time again the same as recovering (...) it?”, under the interpretation of time that passes and in the face of the passage of time, and to clarify the relationships between temporality and the role of art. This study examines the impact of a social desirability response bias as a personality characteristic (self-deception and impression management) and as an item characteristic (perceived desirability of the behavior) on self-reported ethical conduct. Findings from a sample of college students revealed that self-reported ethical conduct is associated with both personality and item characteristics, with perceived desirability of behavior having the greatest influence on self-reported conduct. Implications for research in business ethics are drawn, and suggestions are offered for reducing the effects (...) of a socially desirable response bias. (shrink)

This article reflects on childhood times based on the words chrónos, kairós and aión, which the Greeks use to conceptualize time, in dialogue with different authors, such as Kohan, Pohlmann, Skliar, Kohan and Fernandes. In the pedagogical field, we explore how Pedagogy of Childhood has focused on the importance of childhood temporality and children’s agency, with contributions from Hoyuelos, Parrini, Aguilera et al., Barbosa, Oliveira-Formosinho e Araújo, Oliveira-Formosinho, Pinazza and Gobbi. We reflect on what forms of organizing time (...) are possible when we think about children and their childhoods. Would it be a continuous and chronological time, a time of opportunity for the instant or the timeless intensity of the aiónic? Would it be possible to open spaces in school for other temporalities, given its immersion in chronological time, and its extreme emphasis on routine? We seek a relationship between forms of temporality, philosophy, and early education in order to explore alternative possibilities in the relationship between child and the school context, and conclude that, since the child’s is the aiónic time of intense experience, it is in the heightened dynamic immediacy and the multiple symbolic languages of play that it may be possible to create pedagogical structures that provide a dwelling for childhood temporality. Research teams have used extra-uterine systems to support premature fetal lambs and to bring them to maturation in a way not previously possible. The researchers have called attention to possible implications of these systems for sustaining premature human fetuses in a similar way. Some commentators have pointed out that perfecting these systems for human fetuses might alter a standard expectation in abortion practices: that the termination of a pregnancy also entails the death of the fetus. With Biobags, it might be (...) possible, some argue, that no woman has the right to expect that outcome if the technology is able to sustain fetal lifeafteran abortion. In order to protect the expectation that the termination of a pregnancy always entails the death of the fetus, Elizabeth Romanis has argued that fetuses sustained in Biobags have a status different than otherwise ‘born’ children. In support of that view, she argues that these ‘gestatelings’ are incapable of independent life. This argument involves a misunderstanding of the gestational support involved, as well as a misapprehension of neonatology practice. Here, we argue that any human fetus sustained in a Biobag would be as ‘independent’ as any other premature infant, and just as ‘born’. Neonatologists would seem to have certain presumptive moral responsibilities toward any human fetus gestating in a Biobag. It remains a separate question whether the perfection and widespread application of Biobags for premature human beings would or should alter the expectation that ending a pregnancy also entails fetal death. The field of management has had difficulty embracing the concept of Machiavellianism despite the myriad of studies produced by other fields of social science. It appears that Machiavellianism as a unitary personality construct has limited efficacy in the complex world of organizations. The authors suggest a multidimensional approach to understanding the impact of an individual's threat to organizational functioning. Viewing the construct as discontinuous with two manifestations, predatory and benign, suggestions are made as to the location within organizations where such (...) individuals may be found. Alexander Miller has recently considered an ingenious extension of Frank Jackson and Philip Pettit's account of 'program explanation' as a way of defending non-reductive naturalist versions of moral realism against Harman's explanatory criticism. Despite the ingenuity of this extension, Miller concludes that program explanation cannot help such moral realists in their attempt to defend moral properties. Specifically, he argues that such moral program explanations are dispensable from an epistemically unlimited point of view. I show that Miller's argument for this negative (...) claim is inadequate, and that he has, in spite of himself, identified a promising defence of moral realism. (shrink)

Do time travellers retain their normal freedom and abilities when they travel back in time? Lewis, Horwich and Sider argue that they do. Time-travelling Tim can kill his young grandfather, his younger self, or whomever else he pleases—and so, it seems can reasonably deliberate about whether to do these things. He might not succeed. But he is still just as free as a non-time traveller. I’ll disagree. The freedom of time travellers is limited by a rational constraint. Tim can’t reasonably (...) deliberate on killing his grandfather, certain that he’ll fail. If Tim follows his evidence, and appropriately self-predicts, he will be certain he won’t kill his grandfather. So if Tim is both evidentially and deliberatively rational, he can’t deliberate on killing his grandfather. This result has consequences. Firstly, it shows how evidential limits in the actual world contribute to our conception of the future as open. Secondly, it undercuts arguments against the possibility of time travel. Thirdly, it affects how we evaluate counterfactuals in time travel worlds, as well as our own. I’ll use the constraint to motivate an evidential and temporally neutral method of evaluating counterfactuals that holds fixed what a relevant deliberating agent has evidence of, independently of her decision. Using this method, an agent’s local abilities may be affected by what happens globally at other times, including the future. (shrink)

Causes always seem to come prior to their effects. What might explain this asymmetry? Causation's temporal asymmetry isn't straightforwardly due to a temporal asymmetry in the laws of nature—the laws are, by and large, temporally symmetric. Nor does the asymmetry appear due to an asymmetry in time itself. This Element examines recent empirical attempts to explain the temporal asymmetry of causation: statistical mechanical accounts, agency accounts and fork asymmetry accounts. Hannah Arendt’s essays and lessons compiled in the work Responsibility and Judgment are the guiding principle behind this paper, which intends to address certain moral issues recovered by the author after the publication of Eichmann in Jerusalem ”“ A Report on the Banality of Evil. Taking as focus the relation of the human being to himself, in other words, the silent relation characteristic of the individual who thinks, the author presents the thesis under which, even in the absence of others, (...) the individual is not totally alone, as he shares of himself. Taking this premise into consideration, Arendt affirms that the greatest evil, examined in her work Eichmann in Jerusalem, is committed by the one who refuses to think, or yet, the one who no longer recognizes himself as his own interlocutor, abandoning himself and no longer being incurred as somebody. O presente trabalho busca investigar a formação propagada pelos cursos de Direito do Estado de Alagoas, objetivando avaliar se atendem aos postulados da Educação em Direitos Humanos. Partindo-se do pressuposto de que ainda preponderam o dogmatismo e o olhar legalista na formação dos futuros bacharéis, deixando em segundo plano a formação humanística, adotou-se como opção teórico-metodológica a abordagem de natureza qualitativa, com ênfase na revisão de literatura e na análise dos 18 currículos dos cursos de Direito ofertados em Alagoas. Para (...) a análise dos dados utilizou-se a Análise de Conteúdo de Bardin, elegendo como categorias a presença da disciplina “Direitos Humanos” nos currículos dos cursos de Direito e a proporção de disciplinas de Formação Humanística em relação às técnico-jurídicas. A fim de compreender como a educação em direitos humanos pode influenciar a formação do estudante de Direito, foram analisados os resultados do Enade nos anos de 2006, 2009, 2012 e 2015, nas questões que abordaram, de forma direta ou indireta, os direitos humanos. Friedrich Schleiermacher's theological anthropology re-articulated the Christian doctrine of sin in novel and important ways. Albrecht Ritschl, however, was very critical of Schleiermacher on this topic, claiming that the concept of sin became too individualistic. In the wake of contemporary critiques of individualistic conceptions of sin, this article examines the Schleiermacher-Ritschl anthropological debate in historical perspective and identifies areas of continued value for theological development.

How should one describe the irreducible relationships in photopoetry observed in intermedial literary photobooks? According to most authors, in literary photobooks, the verbal sign system is linked to the photographic image as a bidirectional interaction, creating a coupled system that can be seen as a new sign system. Mutually modulatory influences link verbal text and photography. But the nature of such influences needs to be explained in detail and with accuracy. What kind of relation are we dealing with? Many authors (...) have tried to explain this phenomenon through several epistemic metaphors. The problem is that these metaphors are rarely subjected to any general theory of meaning. Surprisingly, this is not even mentioned as a problem. In this article, we propose a general semiotic model to describe the irreducible photography-poetry relation, derived from C. S. Peirce’s pragmatic theory of signs, and we also present some preliminary results of the analysis of Quarenta Clics em Curitiba, a photobook by Paulo Leminski and Jack Pires. Our purpose here is to introduce and explore this model to describe the photography-poetry relationship in coupled systems. This relationship is decomposed, in the functional roles occupied by poems and photographs, into a sign-object-interpretant relation. The triadic irreducibility that characterizes semiosis (à la Peirce) is the main property applied to photograph-poetry coupling in Quarenta Clics em Curitiba. (shrink)

Fundamental physics makes no clear use of causal notions; it uses laws that operate in relevant respects in both temporal directions and that relate whole systems across times. But by relating causation to evidence, we can explain how causation fits in to a physical picture of the world and explain its temporal asymmetry. This paper takes up a deliberative approach to causation, according to which causal relations correspond to the evidential relations we need when we decide on one thing in (...) order to achieve another. Tamsin's taking her umbrella is a cause of her staying dry, for example, if and only if her deciding to take her umbrella for the sake of staying dry is adequate grounds for believing she'll stay dry. This correspondence explains why causation matters: knowledge of causal structure helps us make decisions that are evidence of outcomes we seek. The account also explains why we can control the future and not the past, and why causes come before their effects. When agents properly deliberate, their decisions can never count as evidence for any outcomes they may seek in the past. From this it follows that causal relations don't run backwards. This deliberative asymmetry is itself traced back to asymmetries of evidence and entropy, providing a new way of deriving causal asymmetry from temporally symmetric laws. (shrink)

ABSTRACT Engaging in sexting, such as sending or receiving of sexual words, pictures, or videos via technology, is a common behavior in minors and a rising trend. This study aimed to understand the ethical dilemmas that clinicians face when working with minors that engage in sexting under current mandated reporting standards. For this study, 178 graduate students and licensed clinicians who work with minors in the state of California completed an online survey involving vignettes concerning issues of sexting behaviors in (...) adolescents. Participants were asked to read each vignette and answer a series of questions regarding their knowledge and attitudes related to the presented issue and whether or not they would breach confidentiality in each case. Results indicated that participants, who had undergone specific training in issues of social media and technology, were significantly more likely to have more declarative knowledge of mandated reporting requirements, however, their reporting behavior was not significantly different from those, who had not previously had any training. Younger clinicians tended to report less than older clinicians. This study highlights the discrepancy that exists between the knowledge of mandated reporting standards relevant to sexting behaviors and clinicians’ reporting practice. (shrink)

What if human joy went on endlessly? Suppose, for example, that each human generation were followed by another, or that the Western religions are right when they teach that each human being lives eternally after death. If any such possibility is true in the actual world, then an agent might sometimes be so situated that more than one course of action would produce an infinite amount of utility. Deciding whether to have a child born this year rather than next is (...) a situation wherein an agent may face several alternatives whose effects could well ramify endlessly on such suppositions, for the child born this year would be a different person—one who preferred different things, performed different actions, and had different descendants—from a child born next year. It has recently been suggested that traditional utilitarianism stumbles on such cases of infinite utility. Specifically, utilitarianism seems to require, for its application, that all experience of pleasure and pain cease at some time in the future or asymptotically approach zero.2 If neither of these conditions holds, then the utility produced by each of two alternative actions may turn out to be infinite, and utilitarianism thus loses its ability to discriminate morally between them. The significance of private standards and associated local level initiatives in agri-food value chains are increasingly recognised. However whilst issues related to compliance and impact at the smallholder or worker level have frequently been analysed, the governance implications in terms of how private standards affect national level institutions, public, private and non-governmental, have had less attention. This article applies an extended value chain framework for critical analysis of Private Standards Initiatives (PSIs) in agrifood chains, drawing on primary research on PSIs (...) operating in Kenyan horticulture (Horticulture Ethical Business Initiative and KenyaGAP). The paper explores the legislative, executive and judicial aspects of governance in these southern PSIs highlighting how different stakeholders shape debates and act with agency. It is argued that governance is exercised ‘beyond the vertical’ in that one can identify wider horizontal processes of governance, including how the scope of key debates is constructed (especially in legislative governance) but analysis of executive governance emphasises the dominant role of the lead buyers. The problem of induction is formulated as a set of three questions, namely: ‘What is the nature of the attitude of acceptance that we adopt in relation to certain theories?’ ‘What are the rules according to which we select those theories which we accept?’ and, ‘What is the justification for the adoption of those rules?’. An original answer is proposed for each question in turn, with the help of the new concepts of sub-theory, established sub-theory, aberrant, arbitrary and degenerate theories. (...) Work done within the realm of what is sometimes called ‘descriptive ethics’ brings two questions readily to mind: How can empirical findings, in general, inform normative debates? and How can these empirical findings, in particular, inform the normative debate at hand? Brick et al 1 confront these questions in their novel investigation of public views about lives worth living and the permissibility of withdrawing life-sustaining treatment from critically ill infants. Mindful of the is-ought gap, the authors suggest modestly that their (...) data ‘may be useful when constructing guidelines for clinical practice’. In this commentary, I consider some potential limitations on the generalisability of these data in the context of policy and clinical practice, limitations which may in turn serve as directions for future empirical research. The authors’ study presented participants six case scenarios, five of which involved the possibility of withdrawing life-sustaining treatment from critically ill infants. The results revealed that “[a]lmost all respondents agreed that at some level of quality of life, life may be of no benefit or worse than death for an infant” and that “participants significantly favoured withdrawal of treatment for the most severe cases.” One salient detail in these scenarios …. O presente artigo tem por objetivo discutir o conceito de natalidade e sua relação com o fenômeno revolucionário a partir do pensamento de Hannah Arendt. Para tanto, laçaremos mão de algumas obras de referência da autora para pensar tal categoria, a saber: Origens do Totalitarismo (1951), A condição humana (1951) e Sobre a Revolução (1963). Para Arendt, o conceito de natalidade está diretamente relacionado a capacidade dos indivíduos de iniciarem coisas novas no mundo, isto é, de serem iniciadores de um (...) mundo inteiramente novo. O fenômeno revolucionário moderno, por sua vez, representa um novus ardo saeclorum, uma novidade que se tornou possível por meio da ação conjunta dos homens e da capacidade de começar própria daqueles que são os recém-chegados ao mundo. Portanto, nosso problema consiste em constatar a centralidade do conceito de natalidade no pensamento político de Arendt, bem como sua relação com o fenômeno revolucionário moderno. (shrink)

No quadro genérico da proposta "Tempo e Temporalidades", aqui num horizonte islâmico, parte-se de um ponto de vista assumidamente fragmentário e regional, intentando alcançar uma posição de observação no interior da concepção do tempo histórico e da memória. Observa-se, assim, a obra e a vida de Ibn Ṣāḥib al-Salāt, proveniente de uma família de notáveis de Beja, procurando seguir os acidentes na formulação de uma memória regional no contexto de uma construção política de modelo imperial como a almôada. No limiar (...) entre as práticas heurísticas e hermenêuticas, regista-se uma rejeição de facto do taqlīd e uma opção pelas memórias pessoais e pelas fontes primárias, consentâneas com o registo de uma história contemporânea que passa ao lado de uma concepção universal islâmica da história.
